These Terms of Use govern access to and use of Property From Australia and its website, content, submission and collaboration features.

Effective date · 23 August 2026 · Last updated · 23 August 2026

01About these Terms

These Terms of Use apply to your access to and use of the Property From Australia website and its content, submission and collaboration features. In these Terms, "Property From Australia", "we", "us" and "our" refer to Holmesly Pty Ltd when operating Property From Australia.

If you do not agree with these Terms, you should not use the website. Separate terms may apply to specific submissions, collaborations or campaigns and will be provided where relevant.

02About Property From Australia

Property From Australia is an independent Australian editorial platform documenting the places, properties, businesses, architecture, design and people shaping Australia. It is a publication, not a real estate agency, property portal, broker or professional advisory service.

03Using the website

You may access and use this website for personal, professional and business purposes consistent with its role as an editorial publication — including reading editorial content, making an editorial submission, and enquiring about collaboration. You agree to use the website lawfully and in a way that does not interfere with its operation, security or availability, or with other people’s use of it. What you may not do is reproduce or commercially exploit our content, which is dealt with in section 07.

04Editorial content

Editorial content is published for general information and interest. It does not constitute financial, investment, legal, architectural, construction or other professional advice, and it should not be relied on as such. You should seek appropriate professional advice before acting on anything you read here.

Property From Australia is independently curated. Editorial inclusion is considered separately from collaboration and is never guaranteed or available for purchase.

05Submissions, contributor rights and licence

5.1 What we accept. Property From Australia accepts editorial submissions relating to property, architecture, design, projects, businesses, places, people and photography. Submitting material does not guarantee publication, and editorial selection, presentation and placement remain at our discretion.

5.2 You keep ownership. You keep ownership of everything you submit. Property From Australia claims no ownership of contributor material. Copyright in photography and other contributed work remains with its owner.

5.3 What you confirm when you submit. You confirm that you own the material or have the permission or authority necessary to provide it to us on these terms, and that any personal information, names or credits you provide about other people are provided with appropriate authority or permission.

5.4 While we are considering your submission. You grant us a non-exclusive, royalty-free licence to receive, store, view, assess and internally discuss your material, and to contact you and relevant contributors to verify facts, credits and permissions. This licence is for editorial consideration only. If we do not accept your material, we acquire no right to publish it.

5.5 If we accept your material for publication. For the material we accept, and for that material only, you grant us a non-exclusive, royalty-free, worldwide licence to: (a) reproduce, publish, communicate, display and distribute it in Property From Australia’s editorial output — our website, our publication, our newsletters, and social and editorial channels we control; (b) apply reasonable editorial formatting, sizing, cropping and colour or file handling required to present it properly across different screens and formats, without altering its substance or meaning; (c) reproduce extracts, thumbnails and previews to promote the published work and Property From Australia’s own editorial activity; and (d) retain and reproduce it as part of our archive and publication records.

5.6 Limits on this licence. This licence exists so we can publish and promote editorial work. It does not permit us to sell your material, to license it commercially to unrelated third parties for their own purposes, or to use it in paid advertising for another business, without your separate agreement. It is non-exclusive: you remain free to publish your material elsewhere.

5.7 Social and distribution platforms. Publishing on third-party platforms such as Instagram requires us to grant those platforms the licence their own terms require in order to host and display what we post. By agreeing to clause 5.5 you agree that we may post accepted material to Property From Australia’s own channels on those platforms on that basis. This is limited to distribution of our editorial output through our own accounts. It does not permit those platforms, or anyone else, to acquire rights from us for unrelated commercial use, and it does not permit us to supply your material to a third party for their own campaigns.

5.8 Credit and moral rights. We will credit the author of published photography and other creative work where we have been given the credit information, and we will honour any specific credit wording you tell us about. Consistent with the Copyright Act 1968 (Cth), and so that normal editorial publication can proceed, the author of material accepted for publication — or a person authorised to act for the author — consents to the following specific acts in relation to that material: (i) applying the editorial formatting, sizing and cropping described in clause 5.5(b); (ii) publishing it alongside editorial text, headings, captions and other editorial material; and (iii) where a platform’s format does not permit a visible credit on the item itself, providing the credit in the accompanying caption, article or channel description instead. This consent is limited to those acts and to the material actually accepted for publication. It is not a waiver of moral rights and does not extend to derogatory treatment of the work.

5.9 If material was created by someone else. Where the material was created by a photographer, architect, stylist or other author who is not you, you confirm you are authorised by that author to provide it and to give the consent in clause 5.8 on their behalf. If you are not, tell us and we will seek it from the author directly before publishing.

5.10 Declined material. If we decline your submission, the licence in clause 5.4 ends and we acquire no publication rights. We may keep a record of the submission as described in our Privacy Policy.

5.11 Withdrawal and removal. You may ask us to stop using published material. We will consider any request in good faith and will act on it where we reasonably can. We may keep archival copies and records of what was published and the permissions relied on, and we may retain material where we are required or entitled to do so. Where material was already published in good faith, the licence continues to apply to that publication and to our records of it.

5.12 Corrections. If a credit is wrong or missing, tell us and we will correct it. Our approach to corrections is set out in our Editorial Standards.

06Collaborations

We work selectively with brands and organisations whose work aligns naturally with the world Property From Australia documents. Collaboration enquiries do not create any obligation on either party until specific terms are agreed in writing.

Editorial inclusion is considered separately from collaboration and is never guaranteed or available for purchase.

07Intellectual property

The Property From Australia name, brand marks, website design and original editorial content are owned by or licensed to Holmesly Pty Ltd. Photography and other contributed material remain the property of their respective owners and are published with permission or appropriate attribution.

You may not reproduce, republish or commercially exploit content from this website without permission, other than as permitted by law. Requests for reuse can be sent to the contact address below.

08Third-party content + links

The website may feature externally supplied photography, attributed editorial material, embedded social media and links to third-party websites. Third-party content remains the responsibility of its owner, and a link or reference does not imply endorsement. We are not responsible for the content, accuracy or practices of third-party websites or services.

09Accuracy + availability

We take reasonable care with the material we publish, but we do not guarantee that all content is complete, current or error-free at all times. Details about properties, projects, businesses and places may change after publication.

We do not guarantee uninterrupted availability of the website and may change, suspend or discontinue features at any time. Nothing in these Terms excludes, restricts or modifies any consumer guarantees or other rights you may have under applicable Australian law that cannot be excluded.

10Prohibited use

You must not misuse the website, including by attempting to gain unauthorised access, interfering with its operation or security, scraping or harvesting content or data at scale without permission, submitting unlawful, misleading or infringing material, or using the website to send spam or other unsolicited communications.

11Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded. Those rights prevail over anything in this section.

Subject to that, and to the extent the law permits: we are not liable for loss that was not reasonably foreseeable; where we are liable in connection with services supplied to you, our liability is limited to resupplying those services or paying the cost of having them resupplied; and we are not liable for the acts, content or omissions of third parties, including third-party websites, platforms and contributors. We do not limit our liability for fraud, or for anything else the law does not allow us to limit.

12Privacy

Our collection and handling of personal information is described in our Privacy Policy, which forms part of how we operate but is a separate document from these Terms.

13Changes to these Terms

We may update these Terms where the platform, our practices or legal requirements change. The current version is always published on this page with its effective and last-updated dates. Changes take effect when published and apply from that date onwards — they do not change the terms that applied to a submission you have already made, or to material we have already accepted. If a change materially affects contributors’ rights, we will note it on this page. If you do not agree with an updated version, you should stop using the website.

14Governing law

These Terms are governed by the laws of Queensland, Australia. You and Property From Australia submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them. Choosing a non-exclusive jurisdiction means you are not prevented from bringing proceedings elsewhere if another court properly has jurisdiction. Nothing in this section excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or other applicable Australian law that cannot lawfully be excluded.
